Terms.

The rules for using our website, client portal and the Hectic app. Plain English, under the law of England and Wales.

Who we are

These terms are between you and Hectic Software Ltd, registered in England & Wales, company number 17514067. Registered office: Unit 1c Sandown Road Industrial Estate, Watford WD24 7UB. Contact: [email protected].

What these terms cover

They apply to hecticsoftware.com, the client portal ("My project") and the Hectic app on iPhone, iPad, Mac and Android (together, the "Services"). By using the Services you agree to these terms. If you use them for a business, you confirm you can accept these terms for it. Our privacy policy explains how we handle your information.

Who can use the Services

The Services are for businesses and adults aged 18 and over.

Your account

You can sign in to the Hectic app with Apple, Google or email. Keep your sign-in details and any client access codes private, and tell us straight away if you think someone else has used them. You are responsible for what happens under your account. You can delete your account at any time; see Support.

Acceptable use

Don't use the Services to break the law, infringe anyone's rights, send spam, upload malware, or anything harmful or offensive; try to get into accounts, client pages or systems that aren't yours; disrupt, overload, scrape or reverse-engineer the Services, except where the law allows; or impersonate anyone. We may suspend or close access if these terms are broken.

Content you send us

You keep ownership of briefs, messages, files and other material you send us. You give us permission to use it to provide the Services and work on your project. You confirm you have the right to share it.

Our intellectual property

The Services, including their design, text, code, logos and the Hectic name, belong to Hectic Software Ltd or our licensors. You may use them only as these terms allow. Showcase and portfolio material on this site belongs to us or the relevant client.

AI answers

Our AI assistant and "Write it up for me" produce answers with AI, which can be wrong. Nothing an AI says is a quote or a promise. Prices, scope and dates are only confirmed in a written quote from us.

Client projects

Sending a brief does not create a contract. Each project is governed by the written quote or agreement we agree with you, covering scope, price, timings, payment and ownership of the finished work. If that agreement conflicts with these terms, the agreement wins for that project.

Third-party services

The Services link to others, such as PIING, the App Store and Google Play. They have their own terms, and we are not responsible for them.

Availability and changes

We work to keep the Services running, but we can't promise they will always be available or error-free. We may change, suspend or withdraw features. We may update these terms; the date at the top shows the latest version, and continuing to use the Services means you accept the update.

Our liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under English law. If you are a consumer, your statutory rights are not affected. Otherwise, the free Services are provided "as is" and we are not liable for loss of profit, revenue, business, data or goodwill, or for indirect or consequential loss. Our total liability arising from use of the Services (apart from paid project work, which is covered by its agreement) is limited to £100.

Ending use

You can stop using the Services and delete your account at any time. Sections that by their nature should continue, such as intellectual property and liability, continue after that.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer living elsewhere in the UK, you may also bring proceedings in your local courts.
